FeminEnergy® Program Agreement

Thank you for joining Michele Forsberg PT, PC (Company) for our FeminEnergy® Program, your journey begins today!
Please read this agreement carefully before you agree, because you are making an important commitment to the program and to yourself.

THE BASICS
1. You are securing one of a limited number of places in this round of FeminEnergy®.
2. The Price is $1497.00 (USDollars), payable upfront or 3 installments of $500.
3. This Agreement, Disclaimers, Mighty Networks rules, and the Credit Card Authorization are the entire agreement between us. These written documents supersede our prior discussions, emails, online or voice messages. You agree that there is no information that you deem materially important that is not incorporated into this Agreement.

THIS IS WHAT YOUR GROUP PROGRAM INCLUDES
1 Portal Access. You receive access to the FeminEnergy® online portal, and Mighty Networks community which includes written materials, video and audio lessons. You will have lifetime access to the course materials as well as Bonus Materials, and any updates within the program that are made throughout the process.
2. Group Calls. You will have access to a weekly group call for 60-90 min, where Michele and her team will be present to discuss topics which are relevant to the program and answer questions. The purpose of our calls is to create a strong sense of community in a safe environment and discuss many of the issues we face as women. It’s also a chance to discuss areas of the program that need clarification or get assistance with movement practice and alignment concerns. Day/Time of Group call is subject to change. These are live calls via Zoom/Mighty Networks and are also found in the portal.

TERMS

1. NO REFUNDS policy.
By signing this Agreement, you acknowledge that no one has represented to you that refunds are available. Even if you cannot participate for any reason, you will continue to be billed according to the schedule in Section 1 of this Agreement through the end of the Term. If you initiate a chargeback, Michele Forsberg PT, PC may issue an additional $250 fee to you.
2. This Program Is Not A Substitute For Physical Therapy or Other Medical Treatment.
You acknowledge that you will make your own decisions before acting on any information gained from this program. It is further understood that before you utilize any techniques suggested by this program, you should consult licensed medical professionals as applicable.
No medical advice or diagnoses will be given.


3. No Guarantee of Results; Risk of Loss. Results from the group program are greatly dependent upon individual decisions, abilities, and other factors outside Company’s control, and the Company makes no guarantees or warranties that information provided to you through the Program will provide results.  
4. Company Can End Your Participation In The Program.
Company may determine, in its sole discretion and without requiring disclosure of the reason, that the relationship under this Agreement must terminate. In this circumstance, Company will provide a refund to you.
5. Waiver of Liability and Release
I acknowledge that the activities and services provided by Michele Forsberg PT, PC, a Colorado Professional Corporation, (the Company), and all other persons acting in any capacity on behalf of the Company or retained by the Company provide (Services), which involve physical exercise that can be strenuous and may cause bodily injury. I understand that there is an inherent risk of bodily injury when choosing to participate in any physical exercise, sport, wellness, nutritional and/or recreational activities, including the Services. My participation in the Services is a voluntary activity in all respects and I assume all risks of bodily injury and illness that may result from the Services.
In consideration of the Company, and all other persons acting in any capacity on behalf of the Company in providing the Services (The Released Parties), I hereby waive, to the fullest extent permitted by law and on behalf of myself, my children, my heirs, my assigns, personal representatives and all other persons acting on my behalf, the right to bring any suit, action or claim of any kind against any Released Party as a result of my participation in the Services and hereby release and discharge, to the fullest extent permitted by law and on behalf of myself, my children, my heirs, my assigns, personal representatives and all other persons acting on my behalf, the Released Parties, in any capacity, as follows: from any and all liability, claims and causes of action of any nature whatsoever arising from bodily injuries or illness (including emotional and psychological injuries or illness, and death), and damages (both economic and non-economic) or losses of any kind which I may have or which may accrue to me on account of my participation in the Services, regardless of whether such injuries result, in whole or in part, from the negligence of any Released Party.
I further agree to indemnify and hold harmless and defend the Released Parties from any and all liabilities, claims and causes of action of any nature whatsoever resulting from injuries or illness, damages (both economic and non-economic) or loss, including attorney fees, sustained by me arising out of or in connection with or in any way associated with my participation in the Services or resulting from my breach of any of the terms of this document.
I acknowledge that I have been advised to consult with my physician before I undertake any physical activity or nutritional or exercise program, including the Services. I certify that I am in good health and sufficient physical condition to participate in the Services. I acknowledge that I have read and fully understand this Waiver of Liability and Release as set forth above and that I am signing it voluntarily with full knowledge of its contents.

6. Confidentiality agreement:
You have the right to confidentiality and privacy by the group leaders and other group members. Confidentiality within the group setting is a shared responsibility of all members and leaders. While group leaders may not disclose any client communications or information except as provided by law, group members’ communications are not protected. As such, confidentiality within the group setting is often based on mutual trust and respect. As a member of this group, I agree to not disclose to anyone outside the group any information that may help to identify another group member. This includes, but is not limited to, names, physical descriptions, biological information, and specifics to the content of interactions with other group members.
7. Ownership of Copyrighted Written And Recorded Materials.
As a participant, I will not copy, re-engineer, distribute, broadcast, retransmit or otherwise provide access to this information to any other person, for free or paid, without express written consent of Michele Forsberg PT, PC.
